Protection Order & Temporary Relief
A temporary order is a legal instruction that lasts only for a specified period to retain the current status quo.
Sometimes, parties during divorce proceedings try to make it difficult for each other by various means and tricks. Unfortunately, when they do so, they may harm the child as a result of their actions or choices. These temporary orders are intended to prevent damage and interference with the ordinary course of the minor's life.
For example, in the case of an order delaying departure from the country - if the order is not issued immediately, one of the parents may kidnap the children and get the minor out of the country. Then it will not be possible to return the situation to its original state, especially when we are trying to prevent the situation from worsening (for example, when a minor is moved to a country with which Israel does not have an extradition agreement).
Some orders are given to keep the situation as it is and not worsen it. These orders are also given to maintain the minor's health while the parents fight and argue with each other in the divorce proceedings. For example, they ensure medical treatment for a minor, registration in educational institutions, prevention of moving to a remote residence with a minor, and more.
In other cases, delaying an adult's departure from the country is possible. This is because there is a fear that he will disappear without paying alimony or without giving a divorce, which could leave a woman as an "agunah".
In the case of separating a parent from his child, it is possible and desirable to file an urgent remedy to restore contact.
In the case of violence between spouses, it is possible and desirable to file an urgent petition for protection lest irreversible damage be caused.
